We supply products to:

  • Consumers (private individuals)

  • Business customers (including farmers, growers, landscapers, and companies)
     

Different rights may apply depending on your classification.
 

3. Products & Intended Use

TerraSoil products are intended for:

  • Agricultural use

  • Horticulture and gardening
     

They are not intended for human or animal consumption unless explicitly stated.
 

Due to the biological and natural nature of our products:

  • Results may vary depending on environment, handling, and application

  • No guarantee of specific outcomes is provided
     

4. Orders & Acceptance

 

  • Orders are subject to availability

  • We reserve the right to refuse or cancel any order

  • Orders are only confirmed once payment is received (unless otherwise agreed)
     

5. Pricing & Payment

 

  • All prices are listed in EUR (€)

  • Prices may include or exclude VAT depending on customer type

  • Payment methods may include:

    • Online payment gateways

    • Manual payment links

    • Cash on delivery (Malta only, if offered)

Orders may be delayed until payment is confirmed.
 

6. Shipping & Delivery

 

  • Delivery times are estimates and not guaranteed

  • We are not responsible for delays caused by:

    • Couriers

    • Customs

    • External factors beyond our control
       

Customers are responsible for:

  • Providing correct delivery details

  • Any applicable import duties or taxes
     

7. Right of Withdrawal (Consumers Only)

In accordance with EU law, consumers have the right to withdraw from a purchase within 14 days of delivery.

Conditions:

  • Items must be unused and in original condition

  • Customer is responsible for return shipping costs
     

Exceptions may apply to:

  • Perishable goods

  • Opened biological products
     

8. Returns & Refunds

For Consumers:

  • Eligible returns must be requested within 14 days

  • Refunds are processed after inspection
     

For Businesses:

  • Returns are not guaranteed and are handled case-by-case

  • No automatic right to refund unless goods are defective
     

9. Product Handling & Storage

Customers are responsible for proper:

  • Storage

  • Handling

  • Application

This is especially important for:

  • Living soil

  • Microbial products

  • Biological organisms (e.g. nematodes, springtails)

Improper handling may result in reduced effectiveness.
 

10. Limitation of Liability

To the fullest extent permitted by law:

TerraSoil shall not be liable for:

  • Crop failure

  • Yield loss

  • Indirect or consequential damages

  • Misuse or improper application of products

Use of products is at the customer’s own risk.
 

11. Product Disclaimer

All products are sold:

  • “As is”

  • Without guarantees of performance

Natural and biological variability means results may differ between users.
 

12. Business Customers (B2B Terms)

For business customers:

  • No statutory cooling-off period applies

  • Liability is limited to the value of the goods purchased

  • Customer assumes responsibility for commercial use
     

13. Intellectual Property

All website content (text, branding, images) belongs to TerraSoil and may not be used without permission.
 

14. Data Protection

Personal data is processed in accordance with our Privacy Policy.
 

15. Governing Law

These Terms are governed by the laws of Malta and applicable EU regulations.

Any disputes shall be subject to the jurisdiction of Maltese courts.
 

16. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the website constitutes acceptance of any changes.
